General Online Sales Conditions

1.1. The purpose of these General Terms and Conditions of Sale (hereinafter the “GTCS”) is to formalize, execute and process an order placed on the www.marineserre.com
website. They constitute a contract between the Customer (defined below in point 1.2) and MARINE SERRE SARL (hereinafter “Marine Serre”).
MARINE SERRE SARL, whose registered office is located at 134-140, rue d'Aubervilliers 75019 PARIS, e-mail: online@marineserre.com, SIREN number: 831 321 450, IDU number: FR298117_11TFLM, operates the website accessible at the following address: www.marineserre.com , an online sales site for clothing, footwear and accessories.
1.2. The General Terms and Conditions of Sale apply exclusively to natural persons of legal age, who are not merchants and who have full legal capacity to enter into a contractual agreement (hereinafter referred to as the “Customer”).
As a consumer, the Customer has specific rights, which would be called into question in the event that the products acquired on the www.marineserrecom site were related to his professional activity.
1.3. The Customer is invited to keep/save a copy of these GTC. The Customer may save or edit these GTC using the standard functions of his browser or computer.

2.1. Marine Serre's GCS apply exclusively to all orders placed on the www.marineserre.com site and are subject to acceptance by the Customer during the ordering process.
2.2 By validating his/her order, the Customer declares that he/she accepts without reservation the terms of said order as well as the entirety of these GCS.
The Customer acknowledges that he/she is fully aware of the fact that his/her agreement to the content of these GTS does not require the handwritten signature of this document, but results from his/her placing of the order alone.
2.3. Marine Serre reserves the right to modify the GCS at any time by publishing a new version on the website www.marineserre.com. The GCS are those in force at the date of validation of the order.
The different versions of the GCS are archived by Marine Serre. The Customer may request a copy of the old versions of the GTC archived in this way, specifying the date of his complaint.
2.4. The GCS apply to orders placed for delivery in mainland France, including Corsica, and internationally.
2.5. The present GCS are applicable as from the date of validation of the order and remain applicable until the extinction of the guarantees and obligations due by Marine Serre.

3.1 In accordance with article L111-1 of the French Consumer Code, the products offered for sale by Marine Serre are those which appear on the site on the day of consultation of the site by the Customer, within the limit of available stocks.
3.2. While every effort is made to ensure that the photographs, graphics and texts reproduced to illustrate the products presented give as accurate a picture as possible, variations may occur due to the technologies available and the manufacturing techniques used. The consumer is not entitled to any claim in this respect, since these variations do not affect the essential characteristics of the goods sold.
3.3. The goods offered for sale online on the www.marineserre.com site comply with the regulations in force in France. Marine Serre cannot be held responsible in the event of non-conformity with the legislation of a third country.

The Company undertakes to honour orders only within the limits of available stocks.
4.1. The order placement procedure comprises the following stages:
Step 1: product search and selection;
Step 2: product selection;
Step 3: verification of order details, total price and correction of any errors;
Step 4: basket validation and order confirmation;
Step 5: creation of a customer account and entry of the Customer's personal details. The customer account is strictly personal and must not be divulged under any circumstances;
Step 6: validation of the delivery method (if several delivery methods are offered);
Step 7: consultation and acceptance of the GTC;
Step 8: choice of payment method and payment of the order.

4.2. When an order cannot be fulfilled, the Customer is informed by email and has the option of cancelling the order.
4.3. Delivery charges are detailed in article 7.4 of these GTS.
4.4. All orders placed on the www.marineserre.com website are only definitively validated once the customer's payment has been verified. Please note that the presence of an item in the shopping cart does not constitute a purchase or a reservation.
4.5. An order confirmation e-mail acknowledging receipt of the references ordered is automatically sent to the Customer once the order has been validated and paid for.
4.6. The Customer attests to the truthfulness and accuracy of the information thus transmitted.
Marine Serre cannot be held responsible for any harmful consequences resulting from the Customer's error in providing his e-mail address.
4.7. Marine Serre reserves the right to refuse the order for any legitimate reason such as non-payment, problems on the Customer's account or when there is a dispute with the Customer concerning the payment of a previous order.

5.1. Product prices are quoted in the currency of the Customer's country (where available) and include value added tax.
Prices include value added tax (VAT) applicable on the day of the order and any change in the applicable rate will be automatically reflected in the price of products sold by Marine Serre on its website.
5.2. Prices do not take into account additional costs, customs clearance costs in the case of delivery abroad, bank charges or any other costs which are the responsibility of the Customer.
Similarly, product prices do not include Internet access costs, which are borne by the Customer.
5.3. Marine Serre reserves the right to modify its prices at any time but undertakes to apply the prices in force at the time of the order, subject to availability at that time.
5.4. Any order placed on the site for delivery outside the European Union may be subject to customs duties and any taxes imposed when the parcel reaches its destination. These duties are the exclusive responsibility of the Customer and are the sole responsibility of the Customer in terms of declaration and payment to the relevant authorities. Marine Serre is not obliged to check and inform its customers of applicable customs duties and taxes. It is the customer's responsibility to check with the relevant authorities in the country of delivery.

5.5 The transfer of ownership of the products ordered will only be effective after payment of the Customer's order.

6.1. The Customer may pay for his order by ;
- by credit card (Visa, Mastercard or Carte Bleue).
- Paypal
- Klarna
6.2. To pay by credit card, the customer is asked to enter the card number, expiry date, cardholder's name and control number (the number on the back of the card). Depending on the Customer's bank, additional information may be required.
6.3. The transaction is immediately debited from the Customer's credit card after verification of the card details and receipt of debit authorization from the credit card issuer. Marine Serre reserves the right to refuse delivery in the event of non-payment by the Customer and/or in the event of obvious fraud.

6.4. Marine Serre makes every effort to ensure the confidentiality and security of data transmitted on the site. Payment for purchases is made via secure payment platforms.
6.5. The payment operation does not involve any “deposit” or payment of any deposit within the meaning of Article 1590 of the Civil Code, it is a cash sale within the meaning of Article 1583 of the French Civil Code.
6.6. The www.marineserre.com website enables customers to register their bank details in order to pay for future purchases. To do so, the Customer must :
- Pay for their last purchase in euros by credit card on the www.marineserre.com website.
- Enter their bank details (bank details entered on the payment page are encrypted and secure);
- Check the “Save my details for future payments” box on the credit card payment page;
- Confirm payment.

Once payment has been validated, data relating to delivery (address and delivery method), billing and the credit card used are recorded. The customer's bank details are not kept by Marine Serre, but by its payment service providers, on secure servers for a maximum period of 14 months following the date of debit made with the registered card. After this period, the data will be deleted.
The Customer may, at any time, delete the data relating to the registered credit card and/or add another credit card by going to the “my account” section.
6.7 The Customer also has the option of paying by PayPal. After choosing this payment method, the Customer will be redirected to the PayPal website. The Customer must enter his/her login and password and proceed with payment.
With PayPal, the customer's financial information is never communicated to Marine Serre. PayPal encrypts and protects credit card numbers.

7.1. Delivery address: Products are delivered to the address indicated by the Customer during the purchase procedure. In the event of an error in the Customer's contact details, Marine Serre cannot be held responsible for the impossibility of delivering the order. In this context, the costs incurred for the re-routing of the order will be borne exclusively by the Customer.
7.2. Delivery methods: The Customer has a single delivery method for deliveries in Metropolitan France and Europe, via a carrier which provides express delivery within 1 to 4 days of dispatch of the order. For deliveries to other countries, the customer can choose between the express delivery methods offered by the carriers. These carriers ensure delivery within 1 to 4 days from dispatch of the order.
7.3. Delivery times: Delivery times vary according to available stock and the Customer's geographical location.
Products available in stock are delivered within 7 working days (on average, depending on the country) from the day following validation of the order. The time taken to confirm the order, to prepare the order and to dispatch it by the postal service or carrier are all taken into account.

7.4. Delivery and customs charges :
- Free delivery for orders over 300 euros in Europe A and 400 euros internationally.
- Australia: 35 euros
- European Union: Between 10 and 35 euros
- United Kingdom: 15 euros
- United States and Canada: 35 euros
- Rest of the world: approx. 35 euros
Where applicable, customs duties will be payable by the customer for deliveries outside the European Union.
7.5. Late delivery: Marine Serre declines all responsibility in the event of late delivery attributable to the carrier. In the event of late delivery, the Customer is advised to contact the carrier first to establish the state of delivery of the parcel.
Should Marine Serre fail to meet the delivery deadline, it will inform the Customer by e-mail that delivery will be delayed. Beyond the 4 weeks indicated from the date of order confirmation, the Customer will have the option of cancelling the order.
If the Customer is absent on the day of delivery, the deliveryman will leave a delivery notice in the Customer's letterbox, allowing the Customer to collect the parcel from the specified location within the specified time.
7.6. Delivery tracking: The Customer will receive by e-mail the tracking number of the parcel taken in charge, so that he can follow the progress of his order on the carrier's website.

7.8. Checking the order: The customer must check the condition of the packaging on delivery. If the original packaging is damaged, it is the Customer's responsibility to make any reservations or complaints directly to the carrier, or even to refuse delivery. Complaints must be addressed directly to the carrier, with a copy to Marine Serre.

8.1 The Customer has the right to withdraw from the contract, without giving any reason, within a period of fourteen days.
The withdrawal period expires fourteen days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the goods. To exercise the right of withdrawal, the Customer must send a registered letter with acknowledgement of receipt to the following address: MARINE SERRE SARL, 134-140 rue d'Aubervilliers 75019 PARIS (France) or to the following e-mail address: online@marineserre.com of his decision to withdraw from these GCS by means of an unambiguous statement. The Customer may, but is not obliged to, use the model retraction form below. In order for the withdrawal period to be respected, the Customer must send his communication relating to the exercise of the right of withdrawal before the expiry of the aforementioned withdrawal period.

8.1 The Customer has the right to withdraw from the contract, without giving any reason, within a period of fourteen days.
The withdrawal period expires fourteen days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the goods. To exercise the right of withdrawal, the Customer must send a registered letter with acknowledgement of receipt to the following address: MARINE SERRE SARL, 134-140 rue d'Aubervilliers 75019 PARIS (France) or to the following e-mail address: online@marineserre.com of his decision to withdraw from these GCS by means of an unambiguous statement. The Customer may, but is not obliged to, use the model retraction form below. 8.2 Pursuant to Article 221-28 of the Consumer Code, the right of withdrawal described above does not apply to custom-made or personalized products or underwear.
8.3 The consumer will have to return the product to Marine Serre, on time and in any event, no later than fourteen (14) days after he has communicated his decision to withdraw from this contract.
Shipping costs for the first return or exchange are free. Subsequent returns and/or exchanges are at the customer's expense. The latter must return the item(s) in new condition, with labels and unworn, in their original packaging.
8.4. Refunds are made no later than fourteen (14) days from the day Marine Serre has been informed of the Customer's decision to withdraw. Marine Serre may defer the refund until the product has been received back, using the same means of payment as that used by the Customer for the initial transaction.
Compliance with the return conditions set out in these GCS is a prerequisite for reimbursement. Failure to comply with these conditions will result in the refusal of reimbursement for the returned items.
8.5. Any item returned modified, altered, damaged, worn or soiled by the Customer will not be exchanged or refunded. Only Marine Serre can judge the conformity or not of the returned products.
8.6. Marine Serre reserves the right to refuse any subsequent order in the event of fraudulent, abnormal or abusive returns.

9.1. Marine Serre is responsible for all of its obligations under the present contract concluded at a distance. However, Marine Serre cannot be held liable if the non-performance of its obligations is attributable to the Customer, to the unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure.

9.2 Marine Serre strives to maintain a high quality website. Nevertheless, given the constraints inherent in the operation of digital networks, it cannot guarantee the continuity of accessibility to the site www.marineserre.com. The company may not be held liable for any nuisance or damage inherent in the use of the Internet, such as disruption of service, external intrusion, the presence of computer viruses or any event deemed by French courts to constitute force majeure.
Hypertext links may lead to sites other than the www.marineserre.com website, and www.marineserre.com accepts no liability in the event that the content of these sites contravenes the legal and regulatory provisions in force.
9.3. Marine Serre complies with the provisions of the French Consumer Code, and in particular Articles L217-3 et seq. of the said Code, and with the provisions relating to hidden defects in products under the conditions set out in Articles 1641 et seq. of the French Civil Code.

9.4. The law applicable to the present contract is French law. Any dispute relating to the interpretation and execution of these GCS shall be governed by French law.

10.1. The www.marineserre.com site, the services offered, as well as all content, texts, databases, software, visual and audiovisual elements that make it up are the exclusive property of Marine Serre and are protected by intellectual property law. Any reproduction is expressly forbidden without the prior written consent of Marine Serre.

10.2. The MARINE SERRE brand is a registered trademark. No license or authorization to reproduce the MARINE SERRE trademark is granted under these GTCS.

11.1 Marine Serre will ensure the conservation of the written record of the Customer's order for a period of ten (10) years from the delivery which was the subject of the order, unless it is necessary to conserve them for a shorter period or, conversely, for an additional period and will guarantee access to them at any time during this same period. At the end of the retention period, the data will be destroyed or rendered anonymous.

11.2. All computerized data relating to the order of the consumer are archived on behalf of Marine Serre in reasonable conditions of security.

If one or more stipulations of these GTC are held to be invalid or declared as such in application of a law, regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope.

These GCS and the order form express the entirety of the obligations of the parties. No general or specific condition communicated by the Customer may be incorporated into these GTS.
The documents forming the contractual commitments between the parties are, in decreasing order of priority, the order form and these GTS.
In the event of any contradiction between the order form and the GCS, the provisions of the order form shall be the only ones applicable to the obligation in question.

In accordance with article L 612-1 of the French Consumer Code, the Customer is hereby informed that, in the event of a dispute, he may have recourse to a conventional mediation procedure or any other alternative dispute resolution method.

Mediation

In accordance with article L. 612-1 of the French Consumer Code, the Customer, subject to article L.612-2 of the French Consumer Code, has the right to submit a request for amicable resolution by mediation, within a period of less than one year from the date of his or her written complaint to the professional.

This establishment has designated SAS Médiation Solution as a consumer mediation body, by means of a membership registered under number 11268/OC/2203.
